That was what Linda Smith (a pseudonym) was thinking after two thugs broke into her Oklahoma apartment.
One was holding a weapon (she initially thought it was a knife but it turned out to be a screwdriver) at her throat, and the other was pacing back and forth while holding her purse and demanding her money and valuables. She screamed, and was told if she screamed again, she’d be dead.
She was doing as police recommend in robberies – comply with a robber’s demands. But her Lady Smith & Wesson .38 special, which she carries by permit, was hidden in her purse – and the purse was being held by one of the attackers.
Then the situation, suddenly, got much, much worse: One of the robbers demanded that she take off her clothes.
“Come on, what are you waiting for,” he told her as he started to yank on her sweatpants, trying to take them off.

Smith pleaded for her safety and distracted the attackers by telling them she would get her money, which was “in my purse.”
The robbers inexplicably allowed her to drop to her knees and crawl across the floor to her purse, which the second attacker had dropped.
She reached inside, and the first shot was clear of the muzzle and into the torso of one of the attackers before she even pulled the weapon clear of the purse. Four more shots followed shortly and, in the end, one of the attackers was dead and the second was hospitalized facing a murder rap for having participated in a felony in which someone died.
Smith, in an exclusive interview with WND, explained she comes from a family that believes in self-reliance and courage.
“I choose to carry a concealed firearm, because even though I am immensely grateful for the protection from our police departments, I realize they’re not God, so they can’t be everywhere at once.
“Deadly situations can happen in the blink of an eye,” she said. “If you are not proactive … you are a vulnerable target.”

I was raped by an adult male at age 6 years. I am male. Do to the fact that this has had extremely negative effects on my whole life I am in favor of the ladies response to her attackers. As for the English person that said a screw driver is not comparable to a bullet I must say that a puncture to the jugular vein in the neck is as deadly as a bullet. In fact, based on my medical training, you would likely bleed out quicker that way than if you were shot multiple times in the body. This is varified by numerous examples of actual televised cases of multiple bullet wound survivers. These are often shown on Discover Health Channel and the Tv show, “Trauma In The ER”. Thank goodness for the people that know, understand, and defend the right to own and bare arms!

This woman should get a medal – her only mistake was not being a better shot for the second thug.
Based onthe facts presented here, she did the right thing… the only thing I can add, is that I hope she didn’t give a report/statement until at least 24 hours later and not without her attorney present.
Actually her and her boyfriend who was in another room asleep at the time were taken into custody but released abut 4 hours later.

Hah, 5fires’ comment is a huge value sidebar to all of such incidents in the future. Her ending was as good as it gets in terms of ‘outcome’ but in the extreme variance of jurisdictional abuse of our rights, and where this type of ending happens, it could be happy or sad, depending upon how you shoot again afterward, with your mouth.
But her ‘presence of mind’ was state of the art. This proves that the mind is the ultimate primary weapon. Too bad she didn’t have a little higher capacity popgun, maybe the other moron would have dirtnapped as well. I’m sure he’ll now be able to sue her for not having adequate locks on her apartment which suggested that she wanted to solicit sex.
We live in ‘The Mountains’ in northern NYS…… A backhoe, thousands of acres of farm land ….. Situations like this shouldn’t require attorneys and courts. Rather then spend thousands of $$ on ‘legal’ issues… a few $$ of gas would make the entire situation go away……. Always remember, NO WITNESSES!

I am thankful the mass majority of comments are in support for the woman’s efforts to defend her life and her right not to be raped and/or murdered. Of course, considering the typical audience of Jeff’s material and website, this is no surprise really. It would be interesting to see what the tone of the comments would be if this were on a more general website, etc.
Like alot of other people, I teach self defence / tactics and am a LEO (law enforcement officer) – in Canada, I should add. I always encounter people who are not so familiar with the law and therefore default with the thought that they have LESS rights than the criminal element who may attack them. Every time I show a defence to an attack, their usual response is something like, “won’t that get me in jail?” and I then have to educate them with principles such as Disparity of Force, and remind them that they ACTUALLY DO have the right to defend themselves. Excessive force is not permitted by civilians AND LEOs and this is a good thing. So train to utilize reasonable force / necessary force instead and learn how to articulate your actions.

In the end we have to do the best we can. Worrying about legalities is something best left AFTER you are safe from harm and not DURING. And by that I mean, “worrying” to the point of taking NO action just because you are concerned about whether making your attacker non-functional will get legally messy, is not good. And as several posters already mentioned, THAT is why bad guys win. They don’t hesitate in carrying out their actions. THey JUST do whatever they want. No hesitation. No worrying about the law. And good law abiding citizens must also adapt that same clarity of mind when defending themselves… action always bests reaction. It sucks playing catch-up.

I happen to live in Tulsa where the afore mentioned incident took place. The talk of the town for a week was all positive. Our Police force has been cut by one third due a budget crunch. You can only count on yourself at times like these. The police did not want people become armed viglantes so they were minamally supportive in the ladies actions.
For those that think she should have a bigger gun, I disagree. Trained properly, you could kill just as easily with a .22 as a 44 Magnum. I’d rather have my wife shoot something that she’s comfortable with, and trained to shoot, than worry about getting a larger weapon, that maybe she can’t handle as well.
I agree that it is better to be judged by 12 than carried by 6. Going forward we need to get rid of all these liberal judges that want to legislate from the bench, instead of actually following the Constitution!! Remember it will come down to either Justice or Just_Us !!
As far as I am concerned these people should have any right to fairness (perceived or otherwise) stripped from them as soon as they enter someone’s house or attack someone. This rubbish about her not being able to use a gun against them because they were only armed with screwdriver is just that, rubbish. Is there a mathematical equation that people can run through when they are attacked that takes into account the size and number of attackers, what they are armed with, how strong they are and any experience they might have and give an appropriate weapon that the victim can use? A woman with a gun is a fair match-up against two men with a screwdriver. If they didn’t want to get shot, guess what? They shouldn’t have done it.
First and foremost, was she “reasonably” in fear for her life? From the article, I would have to believe she was. Second given the situation I would have to believe that if she had the opportunity, she would have prefered to run screaming bloody murder for help rather than fight! But, her opportunity for flight was taken away from her.
All sentient beings “of sound mind and body” prefer life over death. So again it is reasonable to believe that she did what she had to do to remain among the living. Do you honestly believe that she will not be bothered by this situation for a long time to come? I think that if she had her way about it, she would rather that these dregs of western society would have left her alone and not have had to defend herself in this way.
Good to see a positive outcome to this incident versus another potential victim being murdered or raped by a couple of warts on the ass of society, I hope that the chuckle head still alive gets the book thrown at him. Good job Linda.
I’m sorry if people don’t get satire. If anyone actually thinks that it is a viable plan to just lay back and collect evidence while being raped they are crazy. I do not care what the law says if me or mine are attacked I will do anything necessary to stop the attacker. If the law is also my enemy then I will do my best to circumvent it. Bottom line even if I end up in jail if my family is safe so be it.

Uhhhh, why is this even controversial?? People who break into your home automatically lose their rights at the point of entry and are fair game – unless you are on the side of the criminal… If so, then you are going to whine about their non-existent rights.

Not quiet accurate. In some states you also have to show at least an effort to retreat to safety, even within your own home, before using deadly force. I have no idea if this applies in Oklahoma, but I have lived in states where it does.
Thank goodness that Oklahoma has a “make my day” law –if someone breaks into your house while you are there, it is presumed that you are in a life-threatenting, thus deadly force, situation. You don’t have to talk to them, ask them anything, cowardly “retreat” or anything else. Just shoot them! It is good to live here, although my home state is Texas, which also has the same law.
More of these stories of criminals who get their just punishment should be posted. People in this country need to wake up and realize that there are thousands of these dirt bags out there every day,trying to rob, rape, and pillage hard working,honest decent people, everyday. In Canada they do not want armed victims. I saw a man with a gun rob a gas station after assaulting the attendant. Too bad for the victim, he let the perp decide if he lived or died.
Years ago the men who stalked and killed the subway muggers in Quebec and out west had huge support against the courts. It is really tough to convict someone who uses a gun to kill a perp in Canada.
Oklahoma does not have such foolishness as a law. In Pasadena, Tx a man ( Joe Horn ) was no billed when he took a shotgun to interrupt a day time burglary next door. Congratulations! and thank you, what a lesson for home invaders to learn. Sure in some areas, when someone breaks into your homewhen you are relaxed and resting 1. You have to first ask them if they want to rape you, 2. See if they are carrying a screw driver or a knife 3. Politely ask them to leave or you will call the cops. 4. Then you either wait for them to leave or get raped. 5. When the cops arrive probably 2 hours later, you tell them that you were a law abiding citizen. (was that a rapidly concealed laugh you saw on the cops faces? of course not, after all they are cops) 6. By the way, that is if you are alive. I live in a beautiful but poor third world country and therefore not well versed in the law.
Hence maybe I am a criminal, but I would certainly have shot to kill, first. I pray that more learned and law abiding persons would forgive me.

I live in the UK and firearms may be banned, however we do have the right to protect ones self using reasonable force.
So what if you’re attacked? There are various weapons to hand including sharp knifes, tennis rackets, baseball bat (is usually with the ball and glove just in case they think you got it for beating people up) and then there are things like hairspray cans or aerosol sprays, anything you can pick up and throw and of course you can have a big mean dog!
What they forget here in the UK is that the majority of criminals carry firearms so you’re likely to face one if you’re being attacked these days and that is where the law becomes an ass. We can’t even own a taser just in case.
You have to think about your life or theirs or the 12/6 ratio I have seen here. So if it comes down to a one on one or two on one here 1 attacker is stabbed through the neck and the other is beaten to death with a smelly training shoe then so be it.
They had the right to consider the implications of their actions against you unfortunately when your attacked you have no time to think you just fight for survival.
Another thing these judges have never had the experience of living in the real world and see the world through rose tinted glasses so how can they decide that your actions are far worse that that of a premeditated crime and that you had any choice in how to defend yourself. It’s not like you can ask the attacker whether the soft down pillow is enough to put them out without hurting them too much.
Then again in the auk the attacker has the right to go ahead and sue you for hearting them!
I wish I could put a sign up on my house fore warning these attackers that I will not be responsible for the magnitude and severity of my defence when attacked. I can tell you now that I will probably be arrested for instigating violence or something along the lines.

Most houses in the U. S. are buillt flimsily. There’s no need to break a lock when you can just drive your vehicle through the paper thin walls. In italy our walls are over a meter thick. The front door has 3 inches of steel plating which covers all the door. On top of that another 2 inch layer of solid wood. All the shutters are steel and the windows are bulletproofed. We have two guard dogs, one is a German Shepherd who can hear and smell an intruder, before he can even get to the front door of the building. The other one is a miniature Pinscher whose sense of smell and sound is even more acute. She barkswhenever one of u is within 200 meters of our building. Each of us in the house has a gun and we all know how to use it.And we intend to use it, to either main or disable an intruder. The woman in Tulsa was right in defending herself. Comments that this woman’s actions were “over the top”,and “she would have been arrested in the UK”,are way out of line,and no one can really say they would’t have done the same exact thing if it was there life on the line.

Firearms are not actually banned in the UK. Semi automatic handguns are but rifles or long barrelled revolvers are permitted with a firearms licence. I have such a licence and rifles. Under UK law you have to keep them in a locked 5 bolt steel safe with the ammo in a separate lock box. I often wonder whether I would use one if faced with this scenario and suspect that I would not simply because they would be too difficult to get my hands on.
Under the law, I would be permitted to use reasonable force to defend myself and we do have a law covering justifiable homicide in the UK which would permit me to kill someone if I had done everything else possible within my power to evade the situation and it was a life threatening situation. The problem is that every situation is different. From the outline of this case in Oklahoma, forgetting the gun for now, had she stabbed one in the neck with a stilletto, I suspect she would have been fine under UK law. Of course, she would have been initially arrested but that is expected whilst the investigation is ongoing. She may have even been remanded into custody under a charge of murder/manslaughter but would have eventually been released for using reasonable force to prevent her rape and murder. The new UK government, I think, are looking to get us back to “and Englishman’s home is his castle” scenario where these scumbags automatically lose their rights if they break into your home. Until then, we have to take each situation as we find it and worry about the consequences later…

Here in sunny South Africa she would have been arrested, her gun taken away and brought up on charges of murder. Our law stipulates minimum force to prevent or apprehend the criminal. Absolute bull if you ask me. Best is to make sure that you get them both and make sure they are dead. Dead men tell no lies.
A typical story these crminals would have used here in South Africa is that they knocked on the door asking for food and the lady let them in and then attacked them and killed my friend. Our courts would first look at our constitution which upholds human life and the poor lady would be in deep trouble for killing. Never mind the fact that they could have or would have raped or murdered her. That would not be relevant.
We protect our criminals and not our victims or the hero’s who defend themselves, their families or possessions.

Being a former deputy in FL. I applaud this woments actions. A screwdriver wound is deadly. These guys were ready to take her out if she didn’t comply, or if she did. We have had so many home invasions in FL we had to change the law. (Castle Law) If you invade someones home you are telling that person you are ready to do what every it takes.
This woman had every right to defend herself and I’m glad the outcome was favorable for her. If someone breaks into your home you should not have to determine what their “intent” is before you are allowed to protect yourself or your family. They don’t belong there, plain and simple. There presence alone suggests a threat, they threatened her life if she screamed, and one was holding a screw driver to her throat. What else was she supposed to do?

Second, they had her weapon *in their possession*, and they let her retrieve it?!? Of course it seems like it was her only chance so she went for it. If either perp had a single functioning brain cell they would have scoured the finite contents of her purse and come up with the piece themselves – a risky gamble, with a very different outcome.

I’m glad she did what she did. She had NO choice in the matter. They probably would have hurt her seriously and/or killed her and her boyfriend. Criminals don’t care about human life or others feelings. They thrive on hurting others. They get a sick joy in it.
I have a permit to carry license and I have my gun with me 90% of the time. if I have to use it, I will but, I will try to keep from using it IF at all possible. If someone enters my home or vehicle without being invited in and has evil intentions, chances are they will be carried out one way or the other.
Anyway, she did the right thing in defending herself. She was under attack by two criminal men.

In my opinion there are some really good thoughts here and some verging on fantasy. In most states one can only continue the fight as long as a threat exists. Thus shooting the second man as he was exiting the area could and probably would be seen as a criminal act.
Once again, in most states one can use only enough force to ensure one’s safety. Therefore if you break the screwdriver armed invaders knees and are out of his reach, you must stop your attack.
As far a staying quiet for the first 24 hours; are you really going to let the bad guy get his lies out there before your truth? The bad guy has a screwdriver, tries to stab you, you smack him with ball bat/tennis racket/chair leg, he’s hurt and can’t retreat, he stuffs the screwdriver under the sofa cushions, the cops arrive; you’re not going to tell them where the screwdriver is? CSI is a TV show and NOT real life.
As far as using TFT. I have no doubt it is a viable fighting art, however one must always remember that a good big guy will always beat a good small guy, unless the small guy has a weapon to use as a force multiplier.
All of that said; do everything in your power to ensure the safety of your family and your own life. Even if it means taking the life of another.

Having taken the class, I brought my daughter along before she went to collage to learn this. Telling you from first hand experience on the mats, I had another young woman 90# soaking wet kick my but up and down the mats. I’m 6′ & 240# and not all flab. This was all done slow mo in a safe manner and still my knees ached seriously afterward. I have no doubt she could protect herseft from even a bigger guy than me.
I have also done firearms training in Front Sight NV. Both programs are worth the money and time.
I believe this young lady did the right thing, with one exception, that being, allowing one of the perps. to leave alive. It s a sad fact that in today’s world, it becomes the right of a violent perp. to be able to sue, or lie, and the vuctem becomes a double victem. Not evan counting what the bastard may do in retalliation, afterwards, for being told on. I live in N. W. Arkansas, and I promise you, if that happened to my wife, she would shoot both of them, and to kill. Then wait untill she uid sure they’re dead, then call the police.
She did the right thing. Fools today believe they are entitled to do “whatever” they want to do to people, places or things with no recourse being taken against them. There are some of us who believe in reciprocity paying a return visit on wrongdoers and wrongdoing. For those who believe she was wrong for not laying down and getting RAPED or KILLED,more power to them. Those with that attitude should just go lie down in the middle of a street with a sign around their neck that reads “WALK ON ME, IT’S OKAY!
Someone wrote that the woman overreacted since the assailants were “only armed with a screwdriver.” I wonder if the person who wrote this would volunteer to let someone drive a screwdriver into his or her trachea, carotid artery, or heart, just to prove that a screwdriver is not a deadly weapon?
The woman was outnumbered, being threatened with death, facing stronger opponents, and being menaced with a weapon; how much closer to death does on have to be in order to defend oneself with deadly force? She did the right thing.

There is no such thing as excessive force when someone is trying to harm you or your family. Mentally I am prepared to pull the trigger on anyone that is in my house or trying to harm one of my family. I think the media should do a story another story on what happened and how she was justified in killing the attacker, would be a great story / warning to others criminals, and a reassurance for the general public of their rights.
I also think the one that survived and any brutal rapist should have a tattoo put on their forehead indicating so to the world what they did.
In some middle eastern countries they used to cut people’s hands off for stealing.
Good for her and yes where was the boyfriend? In the next room? Okay they did warn her about screaming again….. I will take that with a grain of salt.
Since when do any criminals INVADE someone’s home just to have tea & cookies??? ( I believe the majority of judges &
juries have never had a .38 S&W shoved up their nose,or been on a monorail & told by a thug that the only way off (for you & wife) is PAST him-the HARD way & ALL the other passengers scatter like roaches w/a 150 watt light switched on). They don’t have a CLUE as to what it’s like to REALLY be involved in the REALITY of being a crime victim.
In my 73+ years I’ve NEVER seen/heard of any criminal being FORCED to commit a crime by someone holding a weapon at their throat. They CHOOSE to commit their crimes and DESERVE no mercy because they have NONE at all for their

In the state of Vermont once they are in the home they’ll get what they got coming. All the panzey liberal a$$Hols who posted here thinking it was over the top nead a reality check. In England the law is very different. Where I live, and where I was a Deputy Sheriff , in Kentucky, You may use deadly force to defend your self or a third party from someone, who is an intruder in your home. For this reason most burglaries occur in the day time, when everyone is gone. The burglars will take great pains to assure themselves you are gone because they do not want to get shot by a home owner. However , burglars, are always armed. If you come home unexpectedly and walk in to your home, and surprise one of these guys , they will kill you to escape!
I always leave a “tell” ,to warn me if someone is in my house, when I return. Using the door that I enter and exit my home with, I leave a twenty dollar bill laying on the floor,( as if it was accidently dropped on the way out of the house) . If that bill is not laying on the floor when I open the door, I will back off and call the police. When a burglar breaks into your house, the first thing he does is to remove your phone from the hook and/or ,cut the phone line. The very next thing he does is make a quick tour of your home to make sure no one is there. During this tour he will snatch any thing valuable. He will not pass up your twenty dollar bill laying in the floor in front of your door. Even if you are armed, resist the urge to rush in to your home to see if anything is missing. It takes ,a minimum, of three armed, trained officers to safely search for an armed intruder and clear a house.
In Kentucky, the young lady who shot the two intruders would have been justified and cleared. She would not have been arrested. Her case would be presented to the Grand Jury and a “No True Bill” would be found in her favor.

This was a happy end to a horrible situation. They deserved to die, this is an unspeakable crime. I wish more victims of crimes like this would do as she did. I give her props !
Of course she was justified! Why are we even discussing it?? She had a reasonable (VERY reasonable) fear for her life and is entitled (by every law in the world) to defend herself at that level. Now, if she had shot them as they were running away or sufficiently disabled, that’s another matter. That’s retribution, and that is NOT allowed…
Absolutely, there is no question she did the right thing she did what she needed to do, to survive.
