One gun isn’t enough.
That was what Linda Smith (a pseudonym) was thinking after two thugs broke into her Oklahoma apartment.
One was holding a weapon (she initially thought it was a knife but it turned out to be a screwdriver) at her throat, and the other was pacing back and forth while holding her purse and demanding her money and valuables. She screamed, and was told if she screamed again, she’d be dead.
She was doing as police recommend in robberies – comply with a robber’s demands. But her Lady Smith & Wesson .38 special, which she carries by permit, was hidden in her purse – and the purse was being held by one of the attackers.
Then the situation, suddenly, got much, much worse: One of the robbers demanded that she take off her clothes.
“Come on, what are you waiting for,” he told her as he started to yank on her sweatpants, trying to take them off.

Smith pleaded for her safety and distracted the attackers by telling them she would get her money, which was “in my purse.”
The robbers inexplicably allowed her to drop to her knees and crawl across the floor to her purse, which the second attacker had dropped.
She reached inside, and the first shot was clear of the muzzle and into the torso of one of the attackers before she even pulled the weapon clear of the purse. Four more shots followed shortly and, in the end, one of the attackers was dead and the second was hospitalized facing a murder rap for having participated in a felony in which someone died.
Smith, in an exclusive interview with WND, explained she comes from a family that believes in self-reliance and courage.
“I choose to carry a concealed firearm, because even though I am immensely grateful for the protection from our police departments, I realize they’re not God, so they can’t be everywhere at once.

Funny how everyone forgets how the intruder decided to break the law and take the risk. Many of our self defense laws are incomprehensible. No one has the right to tell me how to defend my life, as she was doing. They chose to commit the crime.
“One” doesn’t know California self defense laws very well.
There is “disparity of force”, which means that just the fact that it is two men against one woman, in her home, threatening great bodily injury, close enough to her to carry out the threat, already attempted to physically carry out the threat, because there are two men physically stronger, out-numbering her, even if they didn’t have a “weapon”, she was most likely justified in shooting both of them
Also in California, you can legally have a firearm in any location that you consider to be your dwelling.
Wheather it is your home, apartment, hotel room, camp ground, etc. Any you may legally discharge that firearm in immediate defense of life or great bodily injury.
This woman is my hero. Instead of just taking it and hoping for the tender mercies of her attackers, she came up with a game plan, she probably had the correct mindset that she is not just going to survive, but she is going to win this fight. She followed up on her plan and WON. Instead of her needing years of therapy to cope, the surviving bad guy will hopefully need years of therapy to recover from his injuries.
I pray to God (oh my, I used the “G” word) that if it happened to my wife that she would kill both the slime-bags. I know I would if I were there. We are not England, we still have our God given right to self defence garanteed by our wonderful contitution.
Actually the law in CA isn’t as One says when it comes to defending your domicile (even if temporary like a campsite or hotel room), Luis is correct, but it pays to do your own research. There are states in the US that do not have home invasion or home castle laws… in those state’s you’re on a level playing field with criminals in your own home…meaning, you break the law (hurt someone) you are going to be prosecuted. Crazy for sure… and the UK where guns are illegal is even more dangerous to defend yourself with a weapon. Apparently they believe everyone should have the skills of a movie martial artist who can put down any size attacker and still leave him in shape to star in the sequel; or more realistically only police can defend the public, the public have no self defence rights.
There are significant legal risks in owning and keeping handy a gun in CA.. you can’t do it responsibly without significant investment in training, extra equipment and legal issues…. carry it loaded w/o a permit and go to jail… carry it near a K-12 school, go to jail… shoot someone beating the hell out of your car or stealing your property in the street (but not threatening you… go to jail (or at least spend a small fortune defending yourself)… let your gun fall into the hands of a child… go to jail… you need to be very clever to stay legal and safe and defended with a gun.
I think of note here is the presence of mind the woman presented. She hung in there and faked out the perps… Not unlike the 70 something ex marine who had two men bust into his apartment and shove an automatic weapon in his face shouting “you’re dead, give us your money”… he immediatly collapsed and faked a heart attack… luckily he was still carrying his permitted weapon and while his wife came rushing into the room to aid her husband’s “heart attack”, becoming the target of the perp, he pulled and shot them both. repeatedly… two dead, man and wife safe. No charges filed… the machine gun had been stolen from the police (two people very happy they didn’t count on the police for protection who had ultimately been responsible for the attack, but of course did not get prosecuted for being so careless with the weapon).
Although there was no celebrating two deaths either. Two otherwise nice young guys who thought they could make a fast buck off an old defensless man with the help of a big gun. Their families were good enough to understand and forgive.
Any death is a loss. But better to be able to stop a perp than become a statistic. Shoot safe.
They got what they deserved… “Castle Doctrine”
A Castle Doctrine (also known as a Castle Law or a Defense of Habitation Law) is an American legal doctrine claimed by advocates to arise from English Common Law that designates one’s place of residence (or, in some states, any place legally occupied, such as one’s car or place of work) as a place in which one enjoys protection from illegal trespassing and violent attack. It then goes on to give a person the legal right to use deadly force to defend that place (his/her “castle”), and/or any other innocent persons legally inside it, from violent attack or an intrusion which may lead to violent attack. In a legal context, therefore, use of deadly force which actually results in death may be defended as justifiable homicide under the Castle Doctrine.
We need to train people to act as this brave woman did. I am a female cop and I have interviewed rape victims. It’s a fate worse than death. Australian government officials should be put through such a nightmare themselves and they would change their laws overnight. I don’t believe everybody should be able to buy and harbor assault weapons but every law-abiding citizen should be able to buy and be trained to use firearms, as well as other defense systems. The old advice of submitting to an attacker is stupid- a harbinger of worse horrors to come. Fight hard and dirty and if they get killed, they brought it upon themselves.
I agree totally with Beth and wish all scumbags who prey on the innocent would get lead poisoning like those two did. The only way this could have turned out any better would be to have the wounded guy taking a dirt nap so that tax payers would not have to feed his disgusting butt for the rest of his pathetic life…
In most states reasonable fear of death or great bodily injury justifies lethal self defence force. Clearly, a screwdriver to the throat, a home invasion by two men, and a “take your clothes off” threat meet the test. Good for, good thinking, keeping cool under pressure!
But, she was LUCKY. Why didn’t the guy searching her purse find the gun? What if they didn’t let her go for her purse?
As people learn at Frontsight… there are only two places that gun should have been: holstered on her, or in her “gun safe”. And if she has no children in her residence, I’d say on her or with her always.
I didn’t know there were Marquis of Queensbury rules for being raped and/or murdered. What are the ones the rapist must follow?
I believe those two guys got what they deserve, although one ran away without catching a bullet to the head. I would want my wife to do the same. It would be tragic to come home and see my lovely lady raped and murdered lying on the floor. Its really good she stopped them, there might have been more victims after her. Our rights for self defence are slowly disappearing, she did her self and her community a great justice. She should get a medal!!

Thanks for posting this great story. I love it when any person foils their criminal attackers. In my opinion there are not enough of these types of stories.
So to answer your question, “Did this woman go “too far” by killing one of the rapists?” HELL NO! And clearly the guy who only got wounded deserved much more since attacking this woman was not his first deadly criminal act. Please note that his previous crime ended with a murder.
To answer you second question. “Was her sneaky method of “tricking” the intruders the right response?” YES! In any situation where your safety is threatened any action that ends in your survival is the right response.
The only thing this woman did wrong, was let one of these scumbags live……as he’ll turn around, sue her…..then be back on the street to do this to someone else.
There are several items that could have been changed. First a blocking mechanism to “delay” someone breaking in. If they want in, they’ll get in….but a delay would have let her get to her gun before she had to trick them.
Second, if they are in my home, without an invite……I go by the axiom, that if you find yourself in a fair fight…..your tactics suck!!! Learn to kill, and kill quickly!! As they may have more friends outside!!
Remember, When seconds count, the cops are only minutes away!!!
As a student of Krav Maga, your first lesson is; “if a man comes to kill you, kill him first”. The Isreali’s know that the key to survival is , “get there first and remain unrelenting”. At that point it is pure self defense and if you really want to live, you will know what to do in that flash of a second. I am from Massachusett, the land where the politicians think they know what the good of the people is supposed to be. So being even more carefull only means for us, we’ve taken too much time to decide, and most suffer the ultimate fate, at the expense of our all knowing politicians. I am tired of hearing about that class of bad nightmare, and I am trying to find out what I can do to change it. Taking the guns out of the hands of lawabiding citizen, and remaining complacent to convicts and criminals having them is really a death sentence for the average citizen of this state.
So what is this idiot from England saying? That the woman should have allowed the rape to happen? That she should have asked for a screwdriver to make the fight more fair? Too bad the attemped rape didn’t happen to someone this stupid Brit loves.
We should all be impressed w/ her calmness under pressure. After taking a tactical weapons class at Gunsite in Arizona I found that I was quite amped up just going through the “room clearing” exercise on their campus against stationary targets. There is a real likelihood that any of us would sink to the level of our training should such a situation befall us. Yes, we should all work to retain the right to defend ourselves but the deeper lesson (to me at least) is that anyone concerned about personal and filial safety should take advanced weapons training as well as weaponless combat training from such pervayors as can be found on this website and others. It’s not comfortable but it, at the very least, gives the student a distinct and real tactical advantage. As Sun Tzu said, deception is of the utmost importance in any battle.
The individual who described the California situation was also describing Massachusetts also, Judges in the state of Massachustts expect you to run out of the house and leave your things for the ‘perps’ to do what they will with. But what if your house has a cadre’ of weapons? Still the same, leave, only now you just enabled the law to hold you responsible for the weapons they steal and commit crimes with, to hold you responsible, and you get prosecuted for being negligent. Great state we live in EHHH?
Congratulations to the lady! She kept her wits about her and those thugs got just what they deserved. Not only that, but she helped keep taxpayer expenses down with the extra trial of the attacker she killed. Too bad she didn’t kill both of them. Does the ‘Law’, or anyone else, expect them to each wait their turn and fight you one at a time, and give YOU an equal-size screw-driver, so you will not have to use “excessive force”? I guess they expect the intruders to repair your home where they broke in, too.
If they come into MY house, they will get WHATEVER I HAVE WAITING FOR THEM!
They have NO reason to break into my home but to do HARM to me and my FAMILY! They cause me financial harm the second they damage my home by “BREAKING in”! (just as the lady in the story did NOT KNOW if the other assailant also had a weapon, or weaponS, that he had not yet presented.) AND I have NO IDEA what they have already done to others, what their mental state is, or what their ultimate intentions are!
SO, MY only recourse is to REACT INSTANTLY to defend and protect myself and Family and property! Therefore, it will be my ‘ambition’ and intention to END their CAREER in CRIME!
If I do NOT put an END to their ‘career’ INSTANTLY, then how much will my Family suffer because of my hesitation or failure, and how many MORE people will suffer, in the future, if they are allowed to CONTINUE what they are doing?!!
She was obviously wrong. They were only going to rape her. She should have obtained as much evidence as possible so the the police could solve the crime later. If she had enough evidence then even if they killed her the perpetrators might have been caught and dealt with. This would prevent the woman taking the law into her own hand and wrongfully acting as judge, jury and executioner. These men were human beings and did not deserve to die just because their goal in life is to rob, rape and murder. Only criminals and agents of the state should have weapons.

Absolutely she was justified. There was a disparity of force – two bigger stronger men one with an improvised weapon. Also they had ability and reasonable intent to kill – they held a screwdriver to her throat. This woman was perfectly justified to resiist with lethal force. Imagine if she didn’t have the gun and attempted to resist. These men would have absolutely overpowered her. Now imagine if she submitted to their demands! When it comes to protecting your own life or the lives of othrs from a violoent attacck you must respond with overwhelming force. This is the only way to convince a violent attacker to stop.

I believe she acted in her best interest, some people may say; “They only had screw drivers and she had a gun.” But they tend to forget the word “they” meaning more than one. Until you experience for yourself how quickly a predator can turn from a cooperating predator to an attacking predator. Then you’re not likely to really appreciate the dynamics that, someone who has been in that situation. Having work with both criminals and behavior patients, I have seen how quickly these situations can go from bad to real bad in a heartbeat. Gavin De Becker states in his book; “The gift of Fear” that there are two crimes scenes. The first one is where first contact is made. The second is where you are taken to and will most likely fall into the 95% category that doesn’t come back. To me, “home invasion” is the second crime scene and you had better do something quick to upgrade yourself to the 5% tile who makes it out.

I am not a liberal nor an idiot. I believe that a man who tries to rape a woman should be strung up alive in a public place. Then he should be castrated. Then gut him and leave him bleeding to serve as a warning to anyone who would try something like that in the future.
As to GOD there are all kinds of beliefs about her/him. I believe one answer to a prayer for help was, in this woman’s case, criminals dumb enough to let her get to a gun and the courage she had to use it.

In our country, many consider a woman who ends up being raped and/or murdered to be morally superior to a woman who shoots an attacker. And, I have to ask, why is it OK to justify protecting “important” people and money when a father or mother cannot legally carry a weapon to defend themselves or their kids?
We all have a God-given right to self defense. We are morally justified to take another’s life if that person is threatening us (or another person) with severe bodily harm. Unfortunately, a Good Samaritan who comes to someone’s aid or defends their own life can count on spending thousands of dollars on legal fees. Only criminals are considered innocent until proven guilty. You or I would be considered (and charged accordingly) as being guilty until proven innocent.
My hat is off to such a Brave woman. I only wish they all would end like that. Maybe then and only then will we get some of the scum off this planet.

This is an obvious case of justifiable self-defense.
Two men break into her home to rob and rape her, maybe even kill her.
Two men against one woman is overwhelming odds.
One man has a deadly weapon; a screwdriver could be plunged into her neck, chest, or whatever.
She defended herself. Good for her, and the bad guys got what they deserved.
Self-defense is a fundamental right of any man. Those who are not free have allowed someone or something to take away their right to life, libertyand the pursuit of happiness.

California…..???!! Don’t be complacent. Look on Gun Owners of America website. They have ratings on every senator and congressman. I don’t care if you live in Georgia, Texas or where ever. Your guns and your right to defend yourself is a minute away from being taken from you. There are plenty of anti gun politicians in supposedly gun-friendly states!
Not to mention, (for any liberals who may not know this), the 2nd Amendment is NOT about hunting rifles and shotguns or target firearms! It is implicit in allowing us to protect ourselves from thugs. Really glad I live in Colorado. We have a ‘Make My Day Law’ if someone breaks into my house I am allowed to assume lethal intend and use deadly force. The UK analogy is inapplicable. I don’t know about their lethal force laws but here in the US a screwdriver is lethal or at least potentially lethal…..the two men were “acting in concert” and as such susceptible to the same response. You would be well within your rights to kill them both under those circumstances. Even if they did NOT have a weapon, there was a “disparity of force” in that there were two of them, both being male and presumably stronger than a woman and even if there were only ONE male and he was significantly bigger and stronger a case could be made for sufficient “disparity of force” to authorize a lethal response.
One other response to the UK post…..lethal force is lethal force is lethal force. If you have a knife and I have a gun I am not constrained to let you get into range before I employ my lethal force…..and by the same token if I have a knife and you have a gun, you should not let me get within ten feet of you because if you do you will be dead. It is easier to kill with a knife than a gun if you know how to use it and almost impossible to take a knife away from someone without getting cut. A gun, on the other hand only is dangerous from only ONE direction, and if that’s not pointed at you, you are golden.
As a recruit in basic training we had a drill instructor show us how easy it was to disarm a man with a handgun when we were told about the “ten foot rule”. Basically on guard duty you yell halt three times and if they are still advancing at the third halt and or reach ten feet from you, you open fire on them. It takes less than a second to cover ten feet if you lunge and sometimes a person’s reaction time to your sudden lunge is sufficiently long that they will not have time to fire even a hasty shot before you close the distance. Like the other fellow said, if you are in a fight for your life and you find yourself in a fair fight…..your tactics suck.

If you feel your life is in danger, put two rounds to the center of mass and then a head shot. If the perp isn’t down, then empty your weapon and grab the back-up mag and do it all over again.
And, for you folks who live in states such as Illinois come on down to Tennessee. We are a must issue state, right to carry openly or concealed except where posted, and have a Castle Doctrine (if the perp is in your home he/she is bought and payed for). We’ve got four seasons, moderate winters, lakes, mountains, great hunting and fishing and the friendliest folks around. Y’all are all welcome – just don’t come down here and try to make us like Ohio, Michigan or where ever. Only drawback is the price of tickets to see the Vols play football!

The one who lived will undoubtedly be back on the streets again way too soon and is likely to repeat the crime. He might even seek revenge against the brave woman who wounded him.
She should replace her .38 with a .40 S&W caliber semi-auto. It has about twice the muzzle energy (knock down power) as the .38 special and even more than the .45 ACP caliber. Also, with a semi-auto, getting off the second shot is much faster than with a revolver. Police and the military are trained to fire a 2-3 round burst at the central body mass and private citzens should do the same in the type of situation this woman faced. And having double (or more) of the magazine capacity of the revolver could have been a lifesaver if the wounded CRIMINAL had come after her after she had emptied her gun (the report said she fired 5 shots so probably the gun was empty at that point and I don’t imagine her hands were steady enough for a fast speed-load.
Ladies, the recoil of a .40 S&W isn’t all that bad and it carries far more capability to “neutralize the threat” than do the popular “lady guns”.
Those guys got what they deserved. It’s too bad she didn’t nail the other one as well. I applaud her resourcefulness and courage.
I’d say all of us who carry need to be very careful about how we answer such questions in a public forum, considering the potential impact of our comments when read back by a prosecutor at our own trial for defending our own castle. Regardless of how we feel about the subject – and I don’t need any advice or lectures here, knowing myself and how I feel about self defense – we must be cautious in our own interests about our public wording of support for such actions as this lady took. Just be careful: you don’t need to teach a farm dog how to suck eggs. Those of us who carry probably already agree with certain principles. Just be careful about your wording.

It’s too bad something like this needs to be mentioned, but there’s not doubt that, given our legal system these days, anything you say could definitely be used against you – no matter how unrighteous it may seem. We have a “justice department” that is anything but just.

To be completly honest, I think she had every right to kill the attackers who were trespassing in her property. I think the attackers deserved it if im honest, i mean if you where in the womens shoes and you had a gun in you’re purse wouldn’t you do the same? I no if i had the chance i would. At the end of the day the attackers intention was to cause a huge amount of suffering to the woman and i believe in two eyes for an eye,so she was perfectly justified in her actions.
first of all, she wasn’t in england, thank God. if she had been, then she would have been raped and possibly murdered with a screw driver. she would have been defensless.
As a response to the commenter who wrote that we should not harm the attacker and should instead wait for God to hand out justice: God doesn’t smite all the bad guys with lightning bolts, nor does every wrongdoer end up repayed by gaining some kind of awful illness. God put me on this earth just like He did everybody else, and He is going to use me if I am needed. If his purpose is to use me to keep someone from doing further evil, then I will use the skills and opportunities He gives me to carry out that purpose. This may happen if or when someone tries to attack me and instead is repayed for all the injustice they have forced upon others.
For those looking for what God thinks of lethal self defense (from a Biblical perspective), here is a quote from a great theologian of the Civil War era. The idea of “turning the other cheek” is only if somebody slaps you in the face – not threatens your life.
If life is thus sacred, as God’s boon, and is man’s one possession of transcendent value, then to take it away without right is an enormous outrage. Suppose this outrage is obviously about to be perpetrated by an aggressor upon an innocent person. Suppose, also, that the protection of the law is absent, and cannot be successfully invoked? What shall the defendant do? Is it his duty to be passive and yield up his life; or to take the defensive, and protect it by force, even to the extent of taking the assailant’s life if necessary? Human laws and conscience concur in the latter answer. Remember that the aggressor unrighteously creates the dilemma, making it necessary that at least one life must go. Whose had best go? Obviously the life of the criminal, rather than that of the innocent man.
Again: If law subsequently has its just course, the murderer, after his guilty success, will have to die for it. The case is then still stronger: that the passive theory sacrifices two lives, one innocent; whereas the theory of self-defense saves the righteous life, and only sacrifices the guilty one.
Our conclusion is also confirmed by the existence in us of the emotion of lawful resentment, the righteousness of which, within its proper bounds, the Savior allows (Matt. 5:22; Eph. 4:26). For if there is no forcible self-defense against wrong, there is no reasonable scope for this emotion.
The Scriptures expressly confirm us. The right of slaying the housebreaker clearly implies a right of self-defense, Ex. 22:2. The law of the cities of refuge contains the same right, Num. 35:22. I’m in agreement with all those that say to shoot & ask questions later. Your home is just that…it’s your’s & any uninvited intruders shall have to deal with the consequenses. BTW…..what about all the illegals entering our home….USA???? If there was a bounty on them we would have way less problems. Great story. It is one thing to ‘talk’ about self defense and another to actually hear something that worked.
If I am not mistaken from what I read her attackers:
1. were close enough to kill or cripple her
2. had the power to kill or cripple her
3. were acting like they were going to kill or cripple her
4. she had run out of every option
5. her attackers were closer than 21 feet
Did I miss anything? If not, she is justified by the letter of the law.

I am not a liberal nor an idiot. I believe that a man who tries to rape a woman should be strung up alive in a public place. Then he should be castrated. Then gut him and leave him bleeding to serve as a warning to anyone who would try something like that in the future.
As to GOD there are all kinds of beliefs about her/him. I believe one answer to a prayer for help was, in this woman’s case, criminals dumb enough to let her get to a gun and the courage she had to use it.
The GOD of the Old Testament had no problem with blood atonement.
A person who is serious about defence should harden their dwelling. They should arm themselves adequately. Their firearm should be on their person 24/7. They should train and run scenarios especially if there are others in your home. Everybody needs to be involved even if their part is to hide and call 911.
Plan ahead. Don’t panic. Do anything you have to. Survive.

I don’t agree with some of the folks slamming California. My understanding is that California is a no retreat State, that the reasonable person test is applied to the fear of GBI (Great Bodily Injury). So for me #1 a screw driver can be a deadly weapon, #2 Rape would be considered great bodily injury. Several things to remember are, a life cannot be taken to protect property, you should not shoot someone in the back as they are running away, if the attacker is incompacitated or stops his attack then the victim must also stop the counter attack, otherwise the thug can now become the victim. I’m not saying I agree with the above, but this is my understanding of the law. Be careful that your lawyer doesn’t clean up what is left!!
It is sad that one of the intruders had to be killed, but they had no business breaking into her home. She did what she had to do, to defend herself. If the intruders was harming me, or my family, I’ve would of killed them too.
This is the part that just kills me. When the hell did we as a society become concerned with criminals and their “rights”? Why do they have them to begin with???? Why is it ok for them to enter our domains, threaten our well being and livelihood and possibly families and get to hide behind the protection of the law? Why are there even laws to protect criminals??? The foolishness of that concept is so deep, it can only be attributed to higher education. You would have HAD to have gone to college, to dream up something THAT stupid. No one, ANYWHERE, should be prosecuted in ANY WAY for defending their own home or well being. Whether or not the POS is running out of your house or standing over you with a screwdriver, HE MADE HIS CHOICE!!!! No one forced him to enter your home, threaten you, or anything of that nature. A double tap to the skull only ensures that you get to wake up the next day unscathed, and we as a society have on less criminal dependent on our taxes and sympathies.
What possible defense against break and enter is there? “I accidentally broke into this person’s house” “I thought I lived here so I kicked in the door”
Come on people. If they choose to violate the sanctity of your home, we the people should have the right to end them. A 44 slug to the head will stop rape or robbery long before a call to 911.
I guess the long and short of this tirade is I can only wish my wife and my daughter could be that cool under pressure. This woman needs an award. She should not be prosecuted in any way whatsoever.

You would be correct Robin. I live in Canada as well. But I am also a registered and licensed gun owner of both restricted and non-restricted class. I own a 303 rifle and an NP-20 9mm hand gun. They way I had it explained to me once by a police officer I knew basically was, if someone breaks into your house, it’s better to kill them and not call the police. Just make them disappear. If you injure them you are liable.
The laws in this country are just completely bizarre. Someone can break into your house, hurt you, steal your stuff, slip off your porch on the way out and sue you for it….most likely win too. When did this become acceptable?
